The course provides information about the discipline regulating the criminal trial, in the ordinary court and in the Court of Assizes, and allows the exhaustive comprehension of the development of a criminal trial. The course will adopt all the teaching methods allowed by the new structure of the classrooms. In particular, we will use diagrams, flow charts, examples of acts, films that represent key moments of the criminal trial.

Learning Objectives - Part C
The course allows to know the discipline of the criminal trial before the Court and the Court of Assizes. The aim is to provide the capacity to understand the ratio and functioning of institutions, in the light of systematic coordinates, constitutional principles and the discipline of the European Convention on Human Rights. It also intends to provide the competence to address and resolve the main legal issues emerging in the criminal proceding.

It will focus on: the preliminary investigation and the pretrial hearing, the means of investigation and defense investigations, precautionary measures for persons and properties, the debate, the special procedures and the concept of res judicata and its effectiveness in criminal and civil law.

The course will have as object: preliminary investigations and preliminary hearing; the means of proof research and defensive investigations; personal and real precautionary measures; the trial; the special proceedings as well as the concept of res judicata and its criminal and extra-criminal effectiveness. Finally, the general principles of the appeals, the appeal, the appeal to the Supreme Court, the extraordinary appeals constitute an examination subject.

The course will be dedicated to illustrate the dynamics of the trial. It will focus on: the preliminary investigation and the pretrial hearing, the means of investigation and defense investigations, precautionary measures for persons and properties, the debate, the special procedures and the concept of res judicata and its effectiveness in criminal and civil law.
