Il Corso permette di conoscere la disciplina del processo penale ordinario di tribunale e di corte d’assise. Sul piano applicativo sarà possibile comprendere lo svolgimento di un dibattimento penale valutandolo con autonomia di giudizio e tentando di risolvere i problemi pratici discussi. Saranno adottate tutte le metodologie didattiche consentite dalla nuova strutturazione delle aule. In particolare, si utilizzeranno schemi, diagrammi di flusso, esempi di atti, filmati che rappresentano momenti fondamentali del procedimento penale esaltando la capacità di apprendere le nozioni trasmesse.
Si tende a comunicare la capacità di comprendere la ratio degli istituti anche in funzione del sistema nel quale sono collocati.
Si attribuisce la competenza ad affrontare le principali questioni giuridiche che emergono con riferimento alla dinamica processuale argomentando alla luce dei principi costituzionali e della disciplina della Convenzione europea dei diritti umani.
The course provides information about the discipline regulating the criminal trial, in the ordinary court and in the Court of Assizes, and allows the exhaustive comprehension of the development of a criminal trial. The course will adopt all the teaching methods allowed by the new structure of the classrooms. In particular, we will use diagrams, flow charts, examples of acts, films that represent key moments of the criminal trial.

Lectures, conferences, tutorials and seminars which will take place between March and May. Without prejudice to healt emergencies for Covid-19, attending students will participate in a hearing at the Court of Florence; They will acknowledge the experience in a brief report that will be presented in class and at the final exam. Power point presentations and other materials handed out during the lessons, will be available through the Moodle Platform.

For all students there will be an optional written test at the end of the course; the test does not rule out the oral examination. Alternative topics, tailored on students’ knowledge, will be proposed in order to allow the proper development of the test.
The written exam is aimed at verifying students’ ability to present their knowledge in a logical and systematic form and to use the appropriate wording.
The oral exam aims to verify the knowledge of the institutes presented during the course, the mastery of the system and the detail of the study.

The evaluation will be excellent if the answers are exhaustive also with reference to the relevant constitutional principles and relevant jurisprudence. The following profiles will also be taken into consideration: ability to discursively organize knowledge, critical reasoning skills, quality of exposure, competence in the use of specialist vocabulary, effectiveness and linearity of exposure. Descriptive knowledge, more or less extensive, but without critical analysis and without references to the constitutional and jurisprudential context, can allow the exam to be passed but not a particularly high evaluation

The course will be dedicated to the illustration of procedural dynamics. It will concern: the preliminary investigations and the preliminary hearing; the means of seeking evidence and defensive investigations; personal and real precautionary measures; the trial; special proceedings as well as the concept of res judicata and its criminal and extra-criminal effectiveness. Finally, the general principles of the appeals, the appeal, the appeal to the Supreme Court, the extraordinary appeals constitute the subject of examination.

Criminal procedural law B
The subject of study will be the usability of the evidence and the discipline of the registrants in the criminal trial. All the figures of the subjects called to make statements will be examined, from the witness, to the technical consultants and experts. Particular in-depth study will be dedicated to connected or connected defendants, whose discipline has been the subject of successive reforms inspired by different principles, up to law no. 63 of 2001 which attempted to implement the canons of due process with an incisive reform of the p r o b a t o r i o system.
