The course deals with the private law of the third sector, in the light of the new d.lgs. 3 July 2017, n. 117 (Third Sector Code). The course will consider all third sector organizations, with particular regard to volunteering, philanthropy and social enterprises.

Learning Objectives
Acquire adequate knowledge of the third sector, its aims, its discipline and the subjects that animate it in the provision of services and in the construction of welfare policies and implementation of the principle of social solidarity.
Acquire adequate capacity in order to professionally collaborate with third sector organizations, thus grasping the substantial job opportunities that they offer.

Private Law I and Private Law II.
Teaching Methods
The 24 hours of lessons will be used for frontal teaching, giving also space for the reports that the attending students will hold in the classroom on topics indicated by the teacher. The reports will be evaluated for the purposes of the final exam.
The teacher uses the Moodle platform in order to upload the didactic materials and also to interact with the students in dialogue, increasing their critical capacity.

Type of Assessment
The exam consists of the written report presented orally in the classroom during the course in dialogue with the teacher and the students, and of the oral test in accordance with the calendar of appeals.
The examination aims at ascertaining students’ knowledge of the third sector’s legal framework, as well as their linguistic and argumentative skills. The evaluation of the presented reports will be taken into consideration for the purposes of the final evaluation. The exam will be passed only if the student has learned the basic concepts of the subject matter without gross mistakes nor serious shortcomings. If the knowledge acquired by the student is just descriptive, without critical analysis nor coordination among different topics, the evaluation will probably be under 24/30. The evaluation will be excellent only if the student demonstrates full and systematic knowledge, also with regard to the most discussed issues emerging in the legal scholarship and/or in the case-law.
Course program
The course allows you to know the vast scope of the third sector, its complex legislation especially in the light of the new Third Sector Code (d.lgs. 3 July 2017, n. 117), and the most discussed issues emerging in the legal scholarship and/or in the case-law.
In particular the course will focus on: origins and evolution, in the light of constitutional principles, of the legal framework from Civil Code to Third Sector Code; legal definitions and public registration of third sector organizations; concepts of legal subjectivity and patrimonial segregation; third sector bodies and democracy principles; controls and responsibilities; specific types of third sector entities; volunteering and gratuitousness; mutuality and social enterprises; financing of third sector also with regard to the related aspects of inheritance law as well as to social impact investments.
