The course allows you to learn the discipline of the ordinary criminal trial court and the Court of Assizes. One applications it highlights the aim to understand the conduct of a criminal trial evaluating it with independent judgment and trying to solve the practical problems discussed.

Il Corso permette di conoscere la disciplina del processo penale ordinario di tribunale e di corte d’assise. Sul piano applicativo sarà possibile comprendere lo svolgimento di un dibattimento penale valutandolo con autonomia di giudizio e tentando di risolvere i problemi pratici discussi. Saranno adottate tutte le metodologie didattiche consentite dalla nuova strutturazione delle aule. In particolare, si utilizzeranno schemi, diagrammi di flusso, esempi di atti, filmati che rappresentano momenti fondamentali del procedimento penale esaltando la capacità di apprendere le nozioni trasmesse.
Si tende a comunicare la capacità di comprendere la ratio degli istituti anche in funzione del sistema nel quale sono collocati.
Si attribuisce la competenza ad affrontare le principali questioni giuridiche che emergono con riferimento alla dinamica processuale argomentando alla luce dei principi costituzionali e della disciplina della Convenzione europea dei diritti umani.
The course provides information about the discipline regulating the criminal trial, in the ordinary court and in the Court of Assizes, and allows the exhaustive comprehension of the development of a criminal trial. The course will adopt all the teaching methods allowed by the new structure of the classrooms. In particular, we will use diagrams, flow charts, examples of acts, films that represent key moments of the criminal trial.

For exam the student must have passed: General Constitutional Law, Private Law I. It is strongly reccommended to also take the exam of criminal law I.

lectures, exercises and seminars to be held during the months of September, October, November and December. They will be adopted in all educational methodologies permitted by the new structuring of the classrooms. In particular, they will use diagrams, flow charts, examples of acts, films that represent key moments of the criminal proceedings.
Power point presentations and other materials handed out during the lessons, will be available through the Moodle Platform.

Lectures, conferences, tutorials and seminars which will take place between March and May. Attending students will participate in a hearing at the Court of Florence; They will acknowledge the experience in a brief report that will be presented in class and at the final exam. The examination of criminal procedural law can be taken in a single interview, at the end of the second part of the course.
However, attending students will divide the study of matter, arguing in the winter session a midterm corresponding to the first part of the course. This test will be given a provisional assessment, which will be considered in the allocation of the final grade at the end of the interview corresponding to the second part of the course. The intermediate test is effective until the appeal in September.The check consists of several floors: first will be established the student's ability to expose the material using appropriate technical language; Secondly, the ability of the student to resolve any questions of interpretation, starting from the given provisions and by reference to the principles of criminal procedure; Finally will be checked for systematic reasoning.

The exam will be in oral form and will focus on the entire program. Its main objective will be to assess student's ability to present the issues .
The student will be required to address critically the most complex issues and to widely explain the logical steps of the proposed solutions.
For students who have passed the intermediate exam at the end of the first semester, the exam will focus only on the program of second semester. For all students there will be an optional written test at the end of the course; the test does not rule out the oral examination. Alternative topics, tailored on students’ knowledge, will be proposed in order to allow the proper development of the test.
The written exam is aimed at verifying students’ ability to present their knowledge in a logical and systematic form and to use the appropriate wording.
The oral exam aims to verify the knowledge of the institutes presented during the course, the mastery of the system and the detail of the study.

Will consider: the preliminary investigations and the preliminary hearing; the search means of proof and the defense investigations; personal protective measures and real; the trial; special procedures, and the concept of res judicata and its criminal and extrapenale effectiveness.
